CCPA and the rights of California residents

NoodleTools, Inc. is committed to complying with the California Consumer Privacy Act (“CCPA”). As a California resident, CCPA ensures you have certain rights regarding your personal information, and we are committed to helping our customers use NoodleTools products in a compliant manner.

This document forms part of the NoodleTools, Inc. Privacy Policy (the “Privacy Policy”), and is made between NoodleTools, Inc. (the “Company”) and the Company’s customers (each, a “Customer”).

Rights under CCPA

As a California resident, the rights you have under CCPA include:

  • Right to know: You can request that a business disclose to you: (1) the categories and/or specific pieces of personal information they have collected about you, (2) the categories of sources for that personal information, (3) the purposes for which the business uses that information, (4) the categories of third parties with whom the business discloses the information, and (5) the categories of information that the business sells or discloses to third parties. You can make a request to know up to twice a year, free of charge.
  • Right to delete: You can request that businesses delete personal information they collected from you and tell their service providers to do the same, subject to certain exceptions (such as if the business is legally required to keep the information).
  • Right to opt-out of sale or sharing: You may request that businesses stop selling or sharing your personal information (“opt-out”), including via a user-enabled global privacy control. Businesses cannot sell or share your personal information after they receive your opt-out request unless you later authorize them to do so again. Note: NoodleTools does not share or sell personal information with any third party, nor do we engage in any marketing with data collected.
  • Right to correct: You may ask businesses to correct inaccurate information that they have about you.
  • Right to limit use and disclosure of sensitive personal information: You can direct businesses to only use your sensitive personal information for limited purposes, such as providing you with the services you requested. Note: NoodleTools will never use your personal information for any purpose besides providing you with access to and functionality of the NoodleTools platform.

We are required by law to verify your identity before we may address your request.

How to exercise your rights

NoodleTools is used by individuals at the direction and under the privacy contracts of our subscribing schools, districts, and consortia. Under FERPA, our use and maintenance of student personal information that is under the control of the subscribing school, district, or consortium. If you use NoodleTools through a school account and wish to exercise your rights under CCPA, submit your request to the school/district and we will work with them to facilitate your request.

  • Where required by applicable law, we will notify you if and why we are unable to fulfill your request.
  • As required under CCPA, we do not discriminate or penalize anyone for exercising their rights.

Authorized Agent: If you are an authorized agent trying to exercise rights on behalf of a user, please contact their school/district with your supporting verification information required under applicable state law.

 

Categories of personal information we collect:

  • Online identifier
  • Personal information limited to your name and email address
  • IP address
  • Education information; Internet or other electronic network activity information related to your use of our services

No sensitive personal information is collected deliberately as defined under applicable US state laws.

Categories of sources from which the personal information is collected:

  • We collect the personal information directly from you or from your school/district.

Business or commercial purpose for collecting or selling personal information:

We collect your personal information to provide the services, respond to requests you send us, and for the following business purposes:

  • Providing the services in accordance with our contract with the Customer and our Terms of Use, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, and processing payments.
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  • Debugging to identify and repair errors that impair existing intended functionality.
  • Sending you product communications that you have specifically requested to receive.

Categories of third parties with whom we share Personal Information:

  • We do not share your personal information with any individuals or organizations to use for any purpose.

Specific pieces of personal information we have collected:

  • All users: IP address
  • Specific to students: username, full name, email address, school associated with the account, graduation year
  • Specific to educators: username, full name, email address, school associated with the account
  • From users submitting a help request: username, email address, school associated with the account
